The Winners – Which entities compose ARISP system?
Francisco Raymundo – ARISP (Real Estate Registers Association of São Paulo) system comprises 316 Real Estate Registry Officers of the State of São Paulo and also provides access for other 10 states of the Federation, allowing the usage of platforms and electronic tools for more than 1,800 real estate registry offices of Brazil, out of a total of 3,540 registry offices set in the national territory.
The structure of ARISP is formed by many departments of specific management and operation that directly interact with the Registry Officers and Magistrates, besides the agents of the Judicial Branch and Public Authority. The main departments and/or activities are the Institutional Representation, Information Technology, Communication, Education and Training (Register University) and Legal Services, Prerogative Defense, Technical Regulations and Statements. In addition, the structure of services of ARISP provides services of issuance of certificates (also digital ones), digital stamps, Infrastructure Sharing of Communication and Information Technology and Data Centers, among other services of interest of the extrajudicial system.
TW – What is the Center of Shared Electronic Services of the Real Estate Registers?
FR – ARISP Center is constituted in a platform of integrated electronic services that congregates hardware and software for the execution of the Real Estate Electronic Register Service, as established by the Law11.977/2009 and the Provision CNJ n. 47/2015.
The service platform comprises 7 modules of specialized services by category of users and preferential services, such as: Electronic Letter, Registers, On Line Pledge, Electronic Service of Subpoena and Consolidation, National Center of Unavailability of Assets, Trusted Repository of Electronic Documents and On Line Correction Service.
TW – Is the Service Center an integrative platform or a portal?
FR – A portal is understood as a WEB service that distributes or provides services, whether being its own or from partners. This way, ARISP Service Center is an integrative platform, since it does not provide services, whether its own or from third parties, but it performs integration processes between users and registry offices, in order to make them faster, safer and wider concerning the reliability on the services provided by its own registry offices straight to the users.
ARISP Platform operates with the registration of its own users, who access specific and standardized tools that convert requests made via WEB in functional requests for many registry offices that have partnership with the Platform. These requests are attended and answered by the registry offices themselves, which submit information and the requested documents to a temporary repository so that the applicant may get the responses safely. Once the demands are delivered to the applicant, or the period for waiting for the response has passed, the electronic file is disabled, preventing information and documents from being accessed by the Center or other users.
TW – Which support is offered by the Real Estate Electronic Register Service?
FR – The definition of the Service is wide and refers to the innovative environment of the extrajudicial system. The Provision CNJ 47/2015 contextualizes the Service as the process of integration between extrajudicial registry offices, the Judicial Branch, the Public Authority in general, as well as the common users of civil society, in order to provide a perfect, safe and reliable mediation of electronic information and documents that are necessary for the execution of processes in the registry offices, especially those related to qualification, registration and certification, besides publicity, distribution and document traffic from the registry offices to their users.
This way, ARISP Platform provides most of the electronic tools needed to execute these services in its totality. Since the society has dynamic, variable and constantly increasing demands, ARISP Platform has been developed throughout time by the implementation of new tools to reach the final objective to allow the totality of registry services to be concluded out of electronic interactions between users and registry offices.
TW – How does the Registers Portal work?
FR – As mentioned before, the platform was made focusing on the needs of each category of user. The module Registers, which is accessed by the portal “registradores.org.br”, organizes tools and offers services for common users of civil society, such as certificates and electronic protocols, among others. This portal gives access and communication in the common users’ language and rationale, since they are acquainted with neither the registry offices’ procedures nor the complex requirements of the registry activities, which benefits the interactions with the registry offices, converting complex topics while using standardized tools and logical directions previously structured. The Registers portal also provides live and at distance supporting service, which helps in the solution of questions and possible difficulties of users in real time, while they make their requests on the portal.
All requests made on the Registers portal are instantly converted in service orders on the Electronic Letter module, which is the electronic tool the register officers and auxiliaries work with. Immediately, all services executed and informed by the registry offices on the Electronic Letter are converted in responses inserted on the Registers portal for the access of the corresponding applicants.
TW – Are the services executed by the Real Estate Registers Center regulated by the CGJ (the Brazilian Justice)?
FR – All services executed by the Center are contemplated and authorized by the TJSP (Judicial Court of São Paulo) service regulations, issued under the approval of CGJ. The service regulations, on the other hand, state the important details for the application of proper provisions and legislation. This way, the use of State Centers, particularly ARISP Center, is totally based on the existing legal statements.
This is a very important question to contextualize the technological development of extrajudicial services in Brazil. The service regulations and provisions, both of CGJ and CNJ, offer great service to the society, ensuring the technological development and Communication and Information Technology services are offered according to the requirements, such as safety, reliability, preservation of data and information, among others. However, the speed of innovation and implementation of new tools of services sometimes happens carelessly. Portals, applications and tools may become available without following legal criteria and the recommendations from the Justice, making the extrajudicial service environment fragile.
In this case, ARISP cares for the technological development following the legal regulations and technical requirements strictly, which ensures better standards and good practices for our business.
Let’s talk a little about Brazil.
TW – How do you see the political and economic situation of Brazil in the last years?
FR – Brazil is a prosperous and rich nation that is going through unprecedented crisis. It is the result of cyclical economic processes and, mainly, of mistaken and populist decisions, which were plentifully being fed from the political crisis that both preceded and happened after the impeachment of President Dilma Rousseff. The great victims of this process are the people who effectively produce in the country. Productive capital flees from instability. Those who win over economic and political crisis are speculators and rentiers. But there is a silver lining: the next president of the Republic can re-establish the political conditions to govern without doubts about his or her legitimacy. It is the first step to retake the economy, even though it may be needed to face an important agenda of reforms, especially in taxation and social security.
TW – In your point of view, is the criminalization of politicians appropriate or being overdone?
FR – The criminalization of politicians is a worrying phenomenon, since it produces the criminalization of the democracy as a whole. People need to understand that democracy is the practical result of the popular exercise of sovereignty through the vote. Bad parliaments and governments are, somehow, a reflection of the electorate. I have hopes that the democracy will regain its pedagogical characteristic. After all, we learn by our mistakes. And practice makes it better. In this process, however, it is essential to retrieve people’s trust. In order to do that, both democracy and politicians need to demonstrate they are capable of solving practical problems of the citizens. From education to health. From jobs to transportation. From housing to public security.
TW – From 0 to 5, being 0 very bad and 5 excellent, how would you grade:

TW – Recently, ARISP was honored by GCSM with WOCA 2018 Trophy for the environmental work done by ARISP Sustainability. What were these projects?
FR – ARISP understands that the productive sector must exercise a central role on promoting actions for sustainability. Above all, ARISP does its job: it stimulates, through informative campaigns and technical and institutional support, that the real estate registers should be local leaders in terms of sustainability, taking simple actions such as: better utilizing water and sources, recycling waste, taking educational environmental measures and mitigating the CO2 emission through the plantation of trees. We understand that the registry offices are important references for the population, as a public service. For this reason, they are to make the people sensitive to the good examples and practices, aiming the multiplication.
TW – What is the central focus of UNIREGISTRAL?
FR – Are they open to the market or just to ARISP system? UNIREGISTRAL is primarily a project for ARISP, since we see Education as a key element for the Brazilian society. It comes with the purpose of being a corporate university focused on the qualification of the real estate register human resources, providing free courses and specialization, which may be capable of attending the demands of this contemporary world, especially when dealing with Communication and Information Technology. Along its formulation, we have realized that it can still contain motivational and behavioral interfaces – essential in modern politics of human resources management – and the formation of human resources through post-graduation lato sensu, while in the study period. Everything both on live and at distance modes. It is important to clarify that, when it comes to Education, there are no limits for the operation, and this is the path we are engaged to walk on.
TW – How do you assess the current situation of the real estate sector in Brazil?
FR – The real estate sector represents a very important dimension of the national economy, with great capacity of generating formal jobs and income. According to IBGE (Brazilian Institute of Geography and Statistics) data from 2010, around 85% of Brazilians live in cities. This certain strength contrasts with some worrisome data: we know that significant part of housing is irregular concerning domain. There is also the urban sprawl, which demands special attention concerning the dimension of urban planning. Thus, there are two challenges here: the first is related to property regularization that, besides assuring the right to adequate housing, permits that significant illegal part of the city be integrated to the legal city, ensuring more market value. The second is about the improvement of tools of urban politics, since the sustainability of our cities depends on that. The real estate registry is attentive to this movement and willing to cooperate with both interfaces. It is a challenge both to São Paulo and the country.
TW – Last question: If you were the president of the Republic, what would you do on the first day of your mandate?
FR – It is expected that the president of the Republic, who will take on the position on January 1st, 2019, will have two qualities: courage and republican attitude. The first one is key to accomplish reforms that are essential for the future of the nation – especially political, taxation and Social Security reforms. The second is, in fact, expressed as a political virtue, which is absolutely urgent in order to unify the country and govern for all, with firmness, serenity, honesty and, mainly, in a non-arbitrary way. If I had the privilege of governing Brazil, I would urge entrepreneurs and citizens in general to add efforts for the country.
